1. General
The Elinz Shopping site at www.elinz.com.au, (the “Site”) is a shopping website. Our online store allows you to browse, select and order products from CBD Food & Beverage Sydney Pty Ltd (ABN 54 125 070 466).
2. The Product
2.1 We have made every effort to describe the item and our terms fully. Please ensure that you have read and understood the entire product listing, including these terms and conditions, and accepted the costs involved (including shipping charges) before you place a bid or purchase the item. If you have any questions, please ask them prior to bidding or purchase.
2.2 We endeavour to display products at a competitive price. We reserve the right to modify prices published on our website at any time.
2.3 All purchases include GST unless otherwise stated.
3.The Customer
3.1 If you are under eighteen (18) years of age, you cannot order via our online store/s. In the event Elinz suffers any damage or other losses as a result of a transaction entered into by a minor using our website, we reserve the right to seek compensation for such losses from the parents or guardians of the minor who caused any transactions to be entered into via our website.
3.2 Elinz receives no commission or referral fees for installation.
3.3 Elinz is not responsible for any personal grievance or injury caused during installation of purchased items.
3.4 We respect your privacy. We collect, hold, use and disclose your personal information in accordance with the Privacy Act 1988.
4.Postage & Delivery
4.1 We usually post within 2 days of receiving a cleared payment.
4.2 We will deliver each ordered product/s to the place of delivery designated by you. It is the customer’s responsibility to ensure the correct shipping address is entered.
4.3 Every effort is made to deliver ordered products within the estimated delivery time specified on our website.
4.4 We offer free shipping for registered post or regular post, the default shipping method varies from product to product. You can upgrade to express post at a cost for faster delivery. For registered post, it takes 3-5 business days in common locations, but in Western Australia (WA) it could take 5-8 business days depending on the area and Australia Post facilities. For Express shipping, it usually takes 1-2 business days for common areas, but for WA it could take 3-5 business days depending on the area and Australia post Facility. For regular post it usually takes 7 to 14 business days depending on the area and Australia post Facility.
4.5 The estimated delivery times for products are during business hours (9am to 5pm) Monday to Friday excluding VIC Public Holidays.
4.6 Estimated delivery times may vary due to circumstances beyond the control of Elinz.
5. Installation & Fees
5.1 Please note that the installation prices start from $88 based on a Japanese Sedan car, and the exact quote is based on a car to car basis.
5.2 We do not receive commission nor get paid for installation referral, thus, we do not hold responsibility for any damage, electrocution etc. done during installation.
5.3 We are not responsible for the installation/reinstallation of this item and will not refund any installation/reinstallation fee paid for the item to be installed/reinstalled even if the unit is or has become faulty, despite our efforts to avoid fault. (Hence, at your request, and at no charge to you, we can test your item prior to shipment to ensure it is working. Please note that this will involve opening or cutting the manufacturer's sealed packaging, and will delay shipment of your item by 24 hours.)
Please note that items are not tested prior to sending unless requested by you. Despite our efforts to ensure the manufacturer produces products of a consistently high standard, faults can sometimes occur.
5.4 We have recommended installers located in most cities around Australia and have a deal with our recommended installers in which they’ll provide free uninstallation and reinstallation in the unlikely event that the unit becomes faulty within the customer’s 12 month warranty period. If interested, please contact us for installer’s contact details.
5.5 Prior to installing/reinstalling the units, we strongly advise you bench-test the unit first or to test the unit before completely install it into the vehicle to ensure the unit is working as expected as to avoid wasting any time or money.
5.6 It is important for you to understand these terms and conditions before you make any purchases. By making any purchase, you accept these terms and conditions and accept that these terms and conditions (above) remain in force above and beyond any guarantee(s) provided by any other third party. If you do not agree with the above terms and conditions, please do not purchase this item.
6. Compliance
6.1 You agree to be bound by, and comply with, these terms and conditions. In addition to these trading terms, there are terms and conditions that apply to the use of the Site. You agree to comply with the terms of use. You can view Terms of Use here.
6.2 You agree to comply with all relevant laws relating to your use of the Elinz website and your placement of any order through the Site.
Placing an order for Products
6.3 You may order Products by selecting and submitting your order through the online Elinz store in accordance with these terms and conditions.
6.4 Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified (including the delivery and other charges and taxes) at the time you place the order.
6.5 We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the Site.
7. Cancelling an Order
7.1 We may cancel any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:
the Products in that order are not available; or there is an error in the price or the product description posted on the Site for the Product in that order; or
that we reasonably believe your order has been placed in breach of these terms and conditions.
7.2 If we do so, then we will endeavour to provide you with reasonable notice of that cancellation, and will not charge you for the cancelled order.
7.3 You may cancel an order (whether it is accepted by us or not) by contacting Customer Service during Contact Hours at any time prior to the dispatch of that order. Once the order has been dispatched for delivery to you, then you may return the relevant Products in accordance with these terms and conditions.
8. Fees and charges
8.1 We will charge you, and you agree to pay, the purchase price of each Product that is ordered, the delivery fee for your order that we notify to you when you place your order (“Delivery Fee”) and any other fees and charges set out in these terms and conditions.
8.2 All fees and charges identified in these terms and conditions and all prices for the Products include GST where applicable.
8.3 If you cancel an order then:
subject to (b), we will refund any amounts paid by you for that cancelled order;
we will not refund the Delivery Fees where the Products in your cancelled order have been dispatched for delivery.
9. Payment methods
9.1 We accept payment by Internet Banking Transfer, Paypal, Credit Card (Visa or Master only) and Money Order.
9.2 If we are unable to successfully process your credit card or PayPal payment for your order that is accepted by us, then we may cancel your order.
9.3 If we have previously agreed that you are a business customer that may obtain Products from us on a deferred payment basis, then we will invoice you the fees and charges for the Products you have ordered when the aggregate amount payable by you for all orders placed under these terms and conditions reaches or exceeds the agreed amount. You must pay us the fees and charges in accordance with these terms and conditions.
9.4 If you choose to pay by credit card or PayPal, you authorise us to debit the amount that is payable for an accepted order from your nominated credit card or PayPal account.
9.5 You must not pay, or attempt to pay, for Products through any fraudulent or unlawful means.
9.6 We will provide you with a receipt at time of delivery which specifies the total fees and charges for the Products in the order.
10. Damaged Products and returns
10.1 You must check any Product delivered to you to determine if it is damaged. If a Product is damaged on delivery, then you should refuse to take receipt of that Product and notify us through our Customer Service. If you notice damage to a Product after delivery, you should notify us within 14 days of delivery. If so, you may return the product to us in accordance with this clause.
10.2 If you wish to return a Product that is not damaged and that was provided to you under these terms and conditions, then you may return that Product in accordance with our Returns Policy.
10.3 Our Returns Policy is incorporated into these terms and conditions. You can view our Returns Policy here. You must provide us with the invoice we issued to you for your order to make a claim under this clause. If you fail to do so, then we may not provide you with a refund.
11. General
11.1 If the whole or any part of a provision of this agreement is void, unenforceable or illegal in a jurisdiction it is severed for that jurisdiction. The remainder of this agreement has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of this agreement or is contrary to public policy.
11.2 This agreement is governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place.
12. Warranty
12.1 All products come with a 12 months warranty. If the product is faulty you may send the item back to Elinz who will then send the product to the manufacturer on your behalf for repair.
12.2 This Warranty does not cover deliberate physical damage, severe moisture or electrocution due to static short circuiting, inserting the product into damaged equipment or other activity the Customer engages in resulting in product damage.
12.3 Elinz guarantees all products to be working upon receipt of the item, unless otherwise stated. Customer satisfaction is important to us as such if the purchased product is DOA (Dead On Arrival) we will offer a replacement product. To redeem this replacement product the customer agrees to return the DOA/ faulty product to Elinz within 60 days of the date of purchase. Please note: WE DO NOT ISSUE REPLACEMENT UNITS without getting the FAULTY ITEM First. If the unit to return for replacement is faulty, we will send you a return label to return the parcel to us at our cost. Please contact Elinz Customer Service for the return label. If it is a change of mind, then the customer has to bear the postage at their end to send the item back for refund / replacement.
12.4 It is the Customers responsibility to ensure all goods are adequately packaged for safe transit back to Elinz thus eradicating damage to the received item.
12.5 The Customer accepts that despite the best intentions of Elinz to provide products of a consistently high standard, faults occasionally occur. It is not the fault of Elinz when these faults occur. Elinz does however (as stated above) agree to (on behalf of the customer) return faulty products to the manufacturer for repair.
12.6 Please note that items are not tested prior to sending unless otherwise requested by you. At the Customers request, and at no charge to you, Elinz can test products prior to shipment to ensure it is working. The Customer acknowledges that this request will require Elinz to open or cut the manufacturer's sealed packaging, and will delay shipment of your item by 24 hours.
13. Disclaimer
13.1 If you are dissatisfied in any way with your purchase, try talking to us first! We will always try to help you solve any problems and we will provide refunds or replacements if appropriate.
13.2 We try to help our customers to rectify any problems, within reasonable limits. Depending on the situation, we may still entertain warranty requests after the warranty period has expired, however we are under no obligation, and do so on a case-by-case basis.
